Divorce Advice for Ex Pats
Many of our clients live or work outside the UK. However, since the divorce process is predominantly a paper process which can be dealt with without the attendance in UK of the parties, this is not a problem.
Divorce Jurisdiction
You do not always need to live in England in order to have a divorce here. Spouses who have lived abroad for a considerable period may still be able to obtain a divorce in England and Wales. Divorce jurisdiction depends on residence or domicile which can be quite complicated.
Divorce and Pensions
There is often considerable wealth associated with a spouse’s pension. It is vital that its real value is factored into any settlement proposal. We work with pensions actuaries to calculate how best to value it. If there is to be a pension sharing order we will calculate the percentage share. Dealing with public service pension funds is our speciality.
Divorce and Children
It is sometimes difficult for divorcing couples to focus on arrangements for the children of the marriage. Disputes can arise regarding contact between the children and the non resident parent, or over specific issues such as medical care, education and religion. A party may seek to change the child’s name or want a residence order. We will try to resolve these disputes as quickly and smoothly as possible. If a prohibited steps order is required we will act fast to prevent a child being removed from the UK.
